Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the BackMetric website and service (the "Service") operated by Nutrigen Sp. z o.o. ("us", "we", or "our").

1. Acceptance of Terms

By accessing and using this Service, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this Service.

2. Description of Service

BackMetric provides a backlink monitoring service that helps users track the status of their backlinks, receive alerts about changes, and generate reports. We reserve the right to modify or discontinue the Service with or without notice.

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.

4. Billing and Payments

Subscription fees are billed in advance on a monthly or yearly basis and are non-refundable. There will be no refunds or credits for partial months of service, upgrade/downgrade refunds, or refunds for months unused with an open account.

5. Cancellation and Termination

You may cancel your subscription at any time from your account settings. Upon cancellation, your account will remain active until the end of your current billing period. We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

6. Prohibited Uses

You may not use the Service: (a) for any unlawful purpose or to solicit others to perform unlawful acts; (b) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (c) to infringe upon or violate our intellectual property rights; (d) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate; (e) to submit false or misleading information; (f) to attempt to impersonate another user or person.

7. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of NUTRIGEN and its licensors. The Service is protected by copyright, trademark, and other laws.

8. Limitation of Liability

In no event shall NUTRIGEN, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

9. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, and hereby disclaim and negate all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any material changes by posting the new Terms on this page. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
